And the talking heads go …

(OP-ED) — The opinions offered here are just that … from a Libertarian sort of point of view.

Doo, da-doo, da-doo, doo, doo-doo … Doo, da-doo, da-doo, doo, doo-doo …

The foregoing phraseology was taken from Lou Reed’s “Take A Walk On The Wild Side” (in case you hadn’t picked up on that).

And we were all panicking because of the uncertainty involving the 2020 crises (that’s the plural term for more than one crisis). We’ve been hit with several scenarios all of which catapulted themselves into manifestation within months of each other.

CORONAVIRUS … This actually began in China in October of 2019, maybe even earlier. When the Chinese Communist Party realized the type of economic warfare this bioweapon could cause, they decided not to tell the World Health Organization about it … or anyone else for that matter. If it’s any indication of things to come, the labs in Wuhan, China had help, from Dr. Anthony Fauci’s organization and the labs at Duke University at Chapel Hill, North Carolina. $3.27-million in U.S. taxpayer money was sent to Wuhan, along with the lab-developed strains of RNA strands, to be further researched and developed into an retrovirus that literally serves as a catalyst to bring about disastrous results in certain portions of the world’s unhealthy, creating death and emotional mayhem in the process.

POLICE BRUTALITY … And if the coronavirus being unleashed on the U. S. population wasn’t enough, it appears a staged scenario was set wherein a white cop kneeled on a black man’s neck for over 9 minutes until he was dead and did so with apparent wanton impunity, with cameras rolling, not caring about the potential outcome. As if the racial divide wasn’t bad enough, this act against George Floyd (and subsequently others as well) made things worse to the point of inciting riots and creating more panic and fear in the population because certain factions found it convenient to use the Floyd/Taylor platforms to make excuses to infiltrate and purposefully cause anarchist-type behaviors that a majority of young America actually condoned, without realizing WHAT they were condoning.

THE ELECTION CYCLE … And to make things worse, you couldn’t go on social media and say anything without getting berated and verbally assaulted by even your own family members who subscribe to the belief system that “the world owes me a living” or despises what political philosophies you may pontificate on your blog. If being able to socially and psychologically manipulate a population into doing its bidding is any indication of things to come, Congress has well succeeded in using special interest money to scare the shit out of the American population to further drive confusion into the masses. When people are scared or confused, most react emotionally instead of logically. With the nomination of Hon. Amy Coney Barrett playing so close to the elections, America has lost sight of the fact that President Trump has filled more judgeships in the federal system than any other President in the history of America!

You may think Joe Biden might be borderline senile (with dementia or some other undisclosed condition lurking in the background), but there are those who think Kamala Harris will end up finishing out Biden’s term if he’s elected … and in this author’s book, she’s definitely a Marxist. This author cannot understand why the American public would want government control over each individual’s life, because that is where the “left” is taking this country and the media is playing the fiddle quite well in stirring up more confusion and anger as the election cycle turns into a menstrual cycle.

THE FORECLOSURE CRISIS REDUX … And if all of the foregoing wasn’t bad enough, the clock is ticking on millions of Americans who are about to be served with foreclosure notices, sending us back down memory lane to what happened after the 2008 financial collapse … except this time, the banks are flush with cash, not the other way around. And the media has also played right into the fear factor, which prompted this author’s headline because that’s all you’re seeing is what’s on camera … talking heads spewing bullshit. The author has been to multiple news media websites, all of which have an election map showing Biden’s giant lead, some even showing him with 339 electoral votes and the states are still counting and the lawsuits are flying and the media is playing right into that as well.

Sadly, the media missed the fact that the 90-day default rate on mortgages is through the roof and the proverbial ca-ca will be hitting the fan in less than two months when the mortgage loan servicers begin sending out notices of foreclosure in droves.

THE LIBERAL, LEFT-WING, TOTALLY BIASED MEDIA ... And if what the talking heads are doing to precipitate confusion, anger and outrage towards the dissolution American public, one should realize that … like the release of the coronavirus … all of this is deliberate. Everything. QAnon or not. All the dots connect here. Dial up any TV news channel and the diatribe is the same … talking heads who can’t be trusted to report the news instead of sensationalizing and opining on it, virtually creating their own version of how the left controls the “play-by-play” narrative. If anything, THIS should totally scare the hell out of most of you, because this has been going on to the ultimate degree since President Trump took office and Hillary Clinton’s email deletions surfaced.

MORE CIVIL UNREST … MAYBE EVEN CIVIL WAR! This author certainly hopes you’ve taken notice of this section, because if this election cycle blows up, it will be the melted frosting on an already overbaked cake that pushes most civilized Americans to the brink of despair, which is where civil unrest comes in, Antifa, Proud Boys, or whatever. It doesn’t matter how the SHTF, it just happens over time. History repeats itself and those who are ignorant of it are condemned to repeat it. Take away history, which is what has happened in today’s public fools … uh, er, schools … and you have a recipe for a tailor-made group of Nazi children being paraded about and being controlled like ass-puppets by a government with not-so-nice agendas, including vaccines that kill, laced with RNA strands of the AIDS virus and malaria!

What America doesn’t need is a federal mask mandate or another total lockdown. America doesn’t need Anthony Fauci either, because he’s unzipped his fly and espoused his political beliefs against President Trump’s handling of the coronavirus pandemic, if you want to truly call it that. It’s Deep State occasionally rearing its ugly head and it seems to work well to manipulate people in a not-so-positive way.

Frankly, this author sees America turning into a Communist nation if we don’t start thinking things through logically and start implementing better judgment about who we want making decisions for us in higher places.

We may have record voter turnout because the voters are scared of their future. However, looking back at all of the catalysts that were used to evoke emotions in people to make them vote? Someone’s got plans for America that may surprise even those who put the status quo back in power and continue to keep them there. In the meantime, stay safe and keep your powder dry.

THE LESSER OF TWO EVILS

(Op-Ed) — The opines here are never construed as legal advice. They’re just a bunch of IMHO’s with a little common sense thrown in!

I received an email from a fellow in Ireland (County Kildare to be specific), wishing to order a copy of Clouded Titles. I was rather taken aback at why someone from “the other side of the pond” would want to order a copy of this book. Further “enquiry” (which is the Irish term for our “inquiry”) did elicit a response I wasn’t expecting … that Irish citizens have taken up a resistance to the same chicanery by the banks and their barristers there! They apparently have discovered that the notes and the public records don’t make sense and word has it, they’ve even caught barristers lying to the judges in court in trying to steal peoples’ homes in foreclosure … and apparently, there is a movement afoot to expose the entire fracas!

Never having direct exposure to their “system of things”, until I make further enquiry into that country’s dilemma, all I can determine for a certainty is that Ireland has a housing shortage of over 100,000 units and now their foreclosure processes have kicked into gear and have been for some time, with Ireland in lockdown (worse than California). Imagine Ireland with no pubs open? Oh feck! No Guinness? (… and their Guinness is sooooo fresh over there you can’t hold a candle to what we drink here.)

Since we have the International Monetary Fund (IMF) in existence, I can only surmise that the same foreclosure scandals are happening in hundreds of other countries across the globe. Many years ago, a fellow in Australia emailed me to tell me the same securitization crap was happening there … and in Western Australia, they’ve now legalized forced inoculations where they can literally seize you, take you to a private location and strip you naked and stick a needle in your butt! The shapes of things to come.

Now Dr. Anthony Fauci (the alter ego of Dr. Josef Mengele), wants to have a federal mask mandate, flip-flopping on his previous agenda that wearing masks aren’t going to help stop the spread of coronavirus. In fact, there are suppositions about that a “federal lockdown” of the U.S. may occur if a certain presidential candidate gets elected. I shudder to think this country could survive another mandated lockdown without some sort of civil unrest the likes of which were previously precipitated by bad police behavior.

The City of Punta Gorda, Florida’s city commission opted to put a mask mandate into place, forcing everyone to wear a mask when entering a place of business. Guess when it expires? November 3rd. What does that tell you?

By now, with the Hon. Amy Coney Barrett officially sworn in as the new U.S. Supreme Court justice (and the party line dictates and political bitching that ensued), pre-election, we can either say that the President (Trump) was doing his official Constitutional duty or conservatively stacking the deck in favor of a majority of folks he thought would lean to the right. Given the responses of Judge Barrett, I’m not so sure she’s not a right-thinking moderate and will be an asset to the discussions surrounding all of those diatribes that the Democrats have attempted to scare the population with. After all, she does have children of different persuasions. I get her belief system and her compassion, rooted in family values, but taking exception to individualism. The Constitution guarantees the general welfare; not the rest of everything that’s been thrown at us since 1913.

Come November 3rd, no matter what political leaning you subscribe to, it is a fact that the President can attempt to dictate public policy, but COVID or no COVID, this country was doing exceptionally well before the bioweapon hit the U.S. Weigh the consequences before casting your vote. Further, the President doesn’t make the laws. As the country’s chief executive, he can make suggestions, but he’s not the one that votes “Yea” or “Nay” to get it done. He only signs off on what Congress has done if he agrees with its decision. People spend too much time watching the 3-ring media debates, technically geared toward socialist policy, in an attempt to further the Hegelian principle I spoke of in a previous post … create a problem, spread the fear and confusion surrounding the problem, with a solution already in the works, created before the problem occurred with the intent to invoke the solution, claiming the sheeple want it and thus are entitled to have it.

The issues surrounding the political climate in America are generated by those inside the Beltway … in my book, with sinister intent.

Verily I say unto you … if government agents provocateur weren’t involved, you wouldn’t have securitization, which allowed the banks to play in the secondary mortgage markets with the ability to make gobs of money off the backs of hard-working Americans … nor would you have a virus that was sent to Wuhan, China with $3.27-million of our taxpayer dollars for further “cultivation” and subsequent release on the world by a not-so-transparent government monster. In both instances, the U.S. government was involved in some way. And our Congress thinks we should open our doors back up and deal with China? I personally believe protectionism (i.e. border walls, bringing manufacturing jobs back to America, rebuild the infrastructure) is what this country needs right now because we’ve got too many of our own problems to deal with here rather than trying to “buy our friends” elsewhere for the sake of political expediency … using our tax dollars to do it with.

THINGS TO PONDER WHEN IT COMES TO THE “DELAY GAME” IN FORECLOSURES …

(OP-ED) — The author of this post is a consultant to foreclosure defense attorneys and does not offer the following as legal advice but rather as that of the author’s own views based on past experience in paralegal and consulting work.  The post, with the related case example, is for educational purposes only.  

THE “DILEMMA” ONLY GETS BIGGER

I have seen countless cases where a foreclosure defense was mounted against a bank’s attempt to foreclose when there are obvious “glitches” with the bank’s case.  It is in this instance where I offer the following case for your perusal:

US Bank v Manning, 2020 ME 42 (Apr 2, 2020)

The one thing you’ll notice right up front is that at the time of this author’s post, this case was almost 10 years old by the time it got to Maine’s highest court.  I believe I can use any case from any state to exemplify what constitutes a “do-over” after 10 years of throwing money away on attorney’s fees.  I would venture a guess that the property was worth almost what the homeowner (Manning) shelled out in attorney’s fees.  He would not be the first party (as a defendant in a foreclosure case) to spend exorbitant sums trying to stay in his home, all because he thinks he’s “right”.

I would have posted this earlier but due to the corona-crisis and the resulting issues that followed our first recognition of it as a pandemic, I’m now just getting around to this.  My point here is that foreclosure defense means putting whatever remaining resources you have at risk.

Let me explain in ten (10) easy points …

  1. Fighting any case where a REMIC trust is involved means that it’s highly likely bogus documents were created by the servicer’s employees at the direction of either the servicer or the foreclosure mill law firm prosecuting the foreclosure.  That in itself is a minimum of an 18-month delay if the court indulges declaratory relief.
  2. Fighting a foreclosure case when you’re unemployed with limited resources is futile, especially if you’re faced with draining a retirement account, like a 401(k), which by the way, the bank won’t ever get access to via judgment; however, you’d be surprised at how many cases I have gone through where the homeowners did just that in order to pay attorney’s fees.
  3. Fighting a foreclosure case when you’re simply holding the property as an investor is also risky given the courts’ propensity (as in this case) to give the bank a “d0-over”, even if the investor was “right” all along.  Those attorney’s fees are risked capital that could be put somewhere else if the market value and economic condition of the property won’t support it.
  4. As a follow-up to the last paragraph, many homeowners don’t actually make an honest effort to get their property evaluated, whether through an appraisal or a comparable market analysis (CMA) by a real estate agent, to see what the “gamble” is worth compared to risk. Their fight is driven by emotion and not common sense.  If the property is economically challenged, meaning it’s going to need thousands of dollars in repairs and upgrades to make it marketable, it’s not worth spending the money while fighting a foreclosure just because you don’t like the idea of moving to new digs.
  5. On the other side of this equation, I could imply that I’ve spent the last 12 years of my life helping homeowners fight to stay in their homes, only to see the bank win after the homeowners have spent thousands, many of whom got stuck paying the other side’s attorney’s fees because they lost … plus, they had to pay their own foreclosure defense attorney’s fees.  Talk about a great case for neurosis.  I feel guilty sometimes because I’ve given the bank’s attorneys an income, because the banks will pay to get a “win” in their favor.  That is counterproductive in my book, when the homeowner could have cut and run and moved into something more affordable and put it into a trust before things got “dicey”.
  6. Fighting standing issues is the most common thing and judges are keenly aware of that modus operandi. Every attorney will tell you that you should claim the other side lacks standing because it’s a great catch-all if all else fails; however, claiming anything comes with a price.
  7. Because many foreclosure defense tactics are emotionally driven, this has created a “cha-ching, cha-ching” scenario for attorneys who see a real monthly annuity staring them in the face every time a disgruntled homeowner thinks they’re “right”.  It creates impetus that has fueled the business model that many law firms and sole practitioner’s rely on to “stay in their game” even if you lose in the end.
  8. In Manning’s case, this 10-year stretch compares to other cases I’ve looked at, where homeowners have sold businesses to pay lawyer’s fees, knowing that the chain of title documents were trash to begin with, yet a lot of these types of attacks fall on deaf ears with the courts. Without proper case planning as to how the court will react, it’s throwing good money after bad.  What homeowners end up doing is “kitchen sink” pleadings … and these types of pleadings are what racks up attorney’s fees … on both sides of the equation.  This is the primary reason why foreclosure mill law firms don’t come after me (if they happen to find out I’m involved in a case) because they’re getting attorney’s fees too … and then some.  How does it feel knowing that this kind of risk exists, even though you’re trying to do the right thing?
  9. I was given a specific sum certain of over $100,000 spent in fighting a foreclosure for 10 years … and the homeowners lost anyway. What I could have bought with that $100,000 over time (a duplex, where I live in one side and rent out the other side to make my mortgage payments; an apartment building, maybe a 4-plex, where I live in one of the apartments and rent out the other three) instead of giving an attorney an opportunity to create a thriving law practice at my expense.
  10. In this case, the economics of “the game” don’t make sense.  With all of the moves and countermoves in this case, which parallel many other complex cases I’ve looked at, giving a bank a “do-over” (dismissing a case without prejudice), means the bank gets to hit your “reset button” and you get to start all over again defending another foreclosure.  My point on this last comment is, “What’s it worth to your health?”

Given the corona-crisis, with over 15-million claims for unemployment benefits being applied for (many of them mortgagors), you can bet when the moratorium on foreclosures has expired (whenever that may be), there may be some mortgage loan servicers that are going to “take it on the chin” in advance payments so much so, they’ll look for the first opportunity to come after your house.  You can bet if they haven’t filed documents in the land records to “support their claim”, it’s highly likely they will either during or shortly after this crisis ends.

My bottom line (while trying not to be verbose here) … foreclosure defense costs money.  Delay tactics cost money.  Playing the game costs money. It is a “game” to the banks because they play by the numbers while you’re playing with your hard-earned money and equity.  They have the clear advantage because they’re the mortgagees.  They have a contract that you signed.  The deck is already stacked ahead of your decision-making processes.  Understand that whatever claims you bring should be supported by a Plan B.  This is part of foreclosure defense too.  What happens if what you’re trying to do doesn’t work?  This is why I wrote Clouded Titles.

THE CORONA-CRISIS HAS MULTIPLE “SIDE EFFECTS” … 

The corona-crisis is going to produce more than just statistical death tolls.  We have been victimized by both the World Health Organization (who is part of the United Nations), who failed to give us the information before the virus spread to America and the Chinese Communist Party (who created the synthesized product in the Wuhan Level 4 lab in the first place … then covered it up with a lame “wet seafood market” story), which is going to create more than a viral pandemic in terms of loss of life. We’re talking an economic twist of the tail that is going to set off another serious wave of foreclosure filings across the country due to the servicers’ struggle to make advance payments to REMIC investors.

Loan modifications are going to be rare after this is over.  Forbearances … well, if you’re lucky.  You may be emotional now … but just remember what kind of financial position you were in before the corona-crisis hit.  This doesn’t stop foreclosures already in progress.  On top of that, you’ve had a financial “hit” just trying to stay alive during the “lockdown” period and the neuroses this has caused … you also have to look at the emotion and health issues (fueled by stress) which weaken your body’s immune system because of what’s coming.  You will be looking to the government for answers … and the answers won’t be there.  The courts will be backlogged.  Your judicial foreclosures will cost more as the courts clear the pipeline of cases. Non-judicial foreclosures will proceed at lightning speed because the servicers have had plenty of time to crank out paperwork (default notices, notices of trustee’s sales, suspect assignments, etc.) during the crisis while the moratoriums existed.  They know this crisis has hit everyone in the pocketbooks, including the mortgage loan servicers themselves.

Now’s the time to come up with a Plan B.

“CORONA-CRISIS” … MANUFACTURED FOR A PURPOSE?

It never ceases to amaze me as to how easy it is to put an entire nation in a state of panic.  This episode was worse than Y2K.  In the last quarter of 1999, there was a huge uptick in consumer spending (hoarding mostly) in preparation for a “D-Day and D-Hour” that never happened.

On January 1, 2000, the clocks all rolled over and the power stayed on.  Nothing happened.  So what was the frenzy all about?  Stocking up on supplies for future use?

Fast forward to September 11, 2001.  We all know what happened then.  Over 3,000 people died.  Years later, first responders are dying of mesothelioma and other respiratory-related diseases.  Was was more interesting was the USA Patriot Act … already drafted and on the shelf … enacted by Congress (without reading it all first), based on what appears to be some political think tank’s “whim”, in an effort to allegedly “protect us” by taking away a few of our constitutional rights to privacy.  In turn, we had to have an enemy, which turned out to be Saddam Hussein.  The U.S. literally created a political vacuum in Iran and the Middle East when it executed Hussein.

Eventually, it destroyed another enemy, namely, Osama Bin Laden; however, we didn’t have photos of his body and no one seems to know “officially” what part of the ocean his body was dumped in, if in fact, that was a fact.

Fast forward to January, 2020. The world gets word that a new “virus” has started to spread in China, apparently originating out of Wuhan, China, wherein there is at least one of the 7 known world centers for bioweapons manufacture.  At that point, the propaganda mills started cranking out disinformation.

Fast forward to March 9, 2020.  The Grand Princess cruise ship has been circling off the coast of Northern California and finally docks at a port in Oakland with over 3,500 people on board, 21 who have tested positive for COVID-19.  As you may be aware, the air conditioning is recirculated on cruise ships (unlike airlines I’ve been told).  The passengers were eventually allowed to disembark and many were taken to treatment facilities and cleared or hospitalized for further treatment. Notice how we haven’t heard a word about their outcomes?

Fast forward to April, 2020.  Spring break has culminated and the college kids have left the beach.  In the meantime, another Princess Cruise liner has docked in the Port of Miami with two dead passengers on board. However, their causes of death were NOT DISCLOSED.  Two other cruise liners docked in the Port at Fort Lauderdale and 14 critically ill people were taken to local hospitals where 11 reportedly died.  The Governor of the State of Florida, under pressure from a lot of political “quarters”, issued “Safer at Home” orders, towing the line with 39 other states who have done similar voluntary quarantines.

Oppression versus Depression.  All of a sudden, the media starts a two-fold campaign. The first is to drive America into a mass panic over a virus that is being used as a tool for the second part of the campaign … to smear President Trump and any other Republican Governor who “hasn’t acted fast enough”.  And the Republicans are pointing back at the Democrats, who they claim have contrived this “hoax” to make the President and the Republicans look bad … does that seem logical?

The “corona-crisis”, for obvious reasons, is now being used for what I believe to me a means of creating more political unrest.  Not only that, look how much “pork” was attached to the stimulus package Congress just passed.  We’re all told (by our two-party system that passed this bill) that this will be a “good thing” for America, just like the USA Patriot Act is a “good thing for America”.

When will you stop acting as if it’s okay for the government to invade your privacy?  When they have drones parked outside your bedroom windows every night, listening to your pillow talk?

Suicide is Painless! 

While there are no specific numbers of note, Scientific American published an article indicating that mass panic is likely to cause people to commit suicide, either over the fact they might be infected or from the stress of believing that the virus “might get them” at some point and they can’t take it any more.  Gee, what a great idea (promote suicide as a way) to clean out “the gene pool”. Suggest that if you can’t take it, suicide is an option.  All the weak-willed morons out there will take them up on that one!  Hey!  Here!  Eat this Tide Pod while you’re at it!   

All of those testing lines that were supposed to be ongoing at all of these “centers” … and a group of “not even journalists” have taken it upon themselves to go out and videotape hospitals that are empty and appear to be devoid of testing for COVID-19 whatsoever … CLICK HERE TO WATCH!

You can take your pick of whatever video you want to watch.  The results appear to be the same.

Are we being lied to about the seriousness of this “pandemic”?   Is this “flatten the curve” mantra nothing more than a way to keep people in their homes?  Was it manufactured to simply “bust up” the supply chain and cripple it long enough for the federal government to accomplish “something else”?  Something even more sinister?

Notice the bickering going on between our two-party system over a budget?  And how much of that “budget” was to be used for actually fighting the corona-crisis?

Now tell me that this “crisis” wasn’t manufactured for a reason!  The government doesn’t take a dump without a reason. We spend way too much time pointing fingers and accusing each other about “woulda, coulda, shoulda” and not enough about being united for a reason.

Hospital layoffs?  Nurses getting fired!  Wait!  I thought we were in a crisis?  WTF?

And if this crisis was so bad, why did Sarasota Memorial Hospital furlough nearly half its workers (Florida) if the pandemic was that bad?  Was it because the “orders” said no elective or unnecessary surgeries are to be performed?  Is it because 99% of all the hospitals in America are making money off of elective and unnecessary surgeries?  Why on earth are people being told to quarantine at home until it gets so bad they have to be transported to a hospital and put on ventilators that are still in short supply?

Why are the numbers of people who have allegedly tested positive for the coronavirus inaccurate?  Take the numbers of those who tested positive and compare that to the number of deaths.  Are we talking a fraction of a percentage point here?  And those people are are told to stay at home and self-quarantine and report the results to their local health departments … why aren’t they listing how many have actually recovered from the virus?  Is it because they need to keep instilling panic in the population?  Was this “crisis” manufactured for the purposes of “control”?   Was it a simulated exercise to see how much panic pressure we can put on Americans before they will either be oppressed into submission or “off themselves” because they can’t take the pressure of being quarantine?  Why are the numbers of those who have “recovered’ not being updated regularly?

And why do I feel as if the foreclosure crisis is about to start up again to the likes of 2009 … and the government will do nothing to stop this from happening past its 60-day mandatory order NOT to foreclose.  Does that seem logical as well?

Do you know where you find the word “sympathy” in the dictionary?  Between “shit” and “syphillis”.

How can I feel sorry for people who put themselves in harm’s way if the “harm” isn’t really there?

Can you honestly say to yourself you know for a fact that the “harm” IS really there? 

We’ll see what happens to the law of averages of this corona-crisis after the 30 day “stay at home” is over … see if they extend it longer and come up with another scare tactic to oppress us all … as we move closer to our November elections.  If in fact, this was a political stunt, who will you put your faith in then? The entire two-party system passed this pork budget!  Go look it up and see how much wasn’t spent on the corona-crisis!  Makes you wonder, doesn’t it?

Now … start thinking for yourselves and analyze WHY you think this crisis might have been created for a reason and post your opinion on this website so you can share your opinion with others who are reading this post.  All lives matter in this “game”!  Your opinion does count … so make it a sane, rational and honest one.  I will not approve posts that are not sane or rational.
