Many homeowners have opted to take the bankruptcy route.  Not to forget those who thought it was a humiliating experience, you should learn from our Commander-in-Chief, who has companies that have filed bankruptcy on numerous occasions to restructure themselves and are still operating!   I’ll discuss bankruptcy pros and cons (the way the banks think) in some detail, including Chapter 11 reorganization proceedings and how they can work to your benefit … without you even being at risk of having your credit rating tainted or having to come up with gobs of money to play the game!  

Getting back on your feet … 

You would think that many homeowners would have learned through their dilemma how NOT to make the same mistake again.  Surprisingly, many homeowners keep repeating the same mistakes again and again, out of desperation.  I’ll be discussing what the industry considers your opportunity for a “bounce back” … for which I’m providing you with a chart:

    If you ever need an example of a case involved in total corruption, our is the perfect example. We’ve been fighting off and on 4 times against complaints trying to foreclose on our home. We had a forensic audit done that showed our assignment had been robosigned in 2014, 4 yrs after the headlines. We can show where their note is a copy as we have a copy of the original. The transcripts had their attorney stating that they didn’t buy the assignment, but the judge is so one sided, he ignored what they said, and tried to speak for them. Our chapter 13 records show that ABN AMRO who was supposed to be the originator lender had stopped accepting our payments as far back as 2004, and subsequently distributed our pymts to Advance and suspense accts for years, without ever informing us, then they tried to pretend we were far behind through a forced insurance scheme, that we proved and won. Our chpt 13 trustee told us bankruptcy cases are handled in state court, and she tried to pretend she didn’t know what an adversary hearing is. Our first Bk atty was a Chpt 7 trustee, which was never disclosed to us, and a conflict of interest. Between 2012-14 we got complete sewer service, and they wrongfully ordered default judgment which we appealed and pulled through. Following that we were offered a trial modification at a low housing price for 17 years which when added up was the same amount they wanted in the first place. My husband wouldn’t sign the final modification amount because it was unconscionable with high interest for so long, and while we were waiting for Ocwen to call us and make an adjustment on the term, they transferred it to another servicer. The story of fraud of committed against us gets even longer, but for times sake, I will withhold for now. I have come to the conclusion that the U.S. has abandoned the consumer for the riches of Wall street. In 2003, it was easy to get an atty to fight predatory lending. Something had to had happened because traces of that era were intentionally removed, and if I didn’t hold the paperwork to prove that there were contingency lawyers back then, I wouldn’t believe it either. I take a knee for the injustice done to the American people to cause so many people to lose their homes often unlawfully. We truly need to drain the swamp all the way, and get a government for the people and not for Wall Street.
